Privacy Policy
We collect what is needed to take and fulfil your order, to keep you informed about it, and — only if you ask us to — to send you occasional updates from MÄRKE. Nothing more.
1Who we are
MÄRKE is operated by VERITAS, a company registered in the Hong Kong Special Administrative Region of the People's Republic of China, with its registered office at Flat B, 11/F Cheung Fai Building, 45-47 Cochrane Street, Central ("MÄRKE", "we", "us", "our").
For all matters relating to your personal data, including requests to exercise your rights, the contact point is contact@markestudio.com.
This Privacy Policy describes the personal data we collect, how and why we use it, who we share it with, and the rights you have in relation to it. It applies to your use of marke-global.com and to any contact you have with us by email or through our social channels.
2The data we collect
Data you provide directly to us
- Identity and contact information — your name, email address, telephone number, and shipping and billing address.
- Order information — the products you have purchased, order value, delivery preferences, and any notes you include with the order.
- Account information — if you create an account, your account credentials and saved preferences.
- Communications — the content of any messages you send to our customer service team, including by email or social media.
Data collected automatically when you use the Site
- Device and connection data — your IP address, device type, operating system, browser type, and language settings.
- Usage data — the pages you view, the time spent on the Site, the links you click, the search terms you enter, and the path through which you arrived at the Site.
- Cookie data — see Section 9 below.
Data we receive from third parties
- Payment confirmation data from our payment processors, indicating the success or failure of a transaction. We do not receive or store your full card number — see Section 4.
- Delivery status updates from our shipping carriers.
- Aggregated analytics data from advertising platforms, where you have consented to cookies on the Site.
3How we use your data
We use your personal data only for the purposes set out below.
- To take and fulfil your order — including payment processing, shipping, customs declarations, and order communications.
- To provide customer service — including responding to your enquiries and processing returns and refunds.
- To prevent fraud and ensure security — including verifying transactions and protecting the Site.
- To comply with legal obligations — including tax, accounting, and regulatory requirements applicable in Hong Kong and any jurisdiction in which we sell.
- To improve our products and the Site — using aggregated and anonymised data to understand how the Site is used.
- To send you marketing communications — only if you have explicitly opted in. You can unsubscribe at any time from the link at the foot of every marketing email, or by emailing us.
4Legal bases for processing
Where data protection law in your jurisdiction requires us to identify a legal basis for processing — including the European Union and United Kingdom General Data Protection Regulations — we rely on the following bases.
- Performance of a contract — to take, fulfil, and support your order.
- Compliance with a legal obligation — to meet tax, accounting, and other regulatory duties.
- Legitimate interests — to operate and improve the Site, prevent fraud, and protect the security of our customers and our business, where those interests are not overridden by your rights and freedoms.
- Consent — for marketing communications and for any non-essential cookies, withdrawable by you at any time.
5Who we share your data with
We do not sell your personal data. We share it only with the parties listed below, and only to the extent necessary.
- E-commerce platform — which hosts the Site and processes orders on our behalf.
- Payment processors — including Apple Pay, Google Pay, PayMe, and any other payment provider displayed at checkout. These providers receive payment data directly; we do not receive or store your full card number.
- Shipping and logistics carriers — including SF Express, Hong Kong Post, DHL, and any other carrier used to deliver your order.
- Email service provider — used to send transactional and (where consented) marketing email.
- Analytics and advertising providers — including Google and Meta, where you have consented to non-essential cookies.
- Professional advisers — accountants, lawyers, and auditors, under duties of confidentiality.
- Government and regulatory authorities — where we are legally required to disclose data, including for tax, customs, and law enforcement purposes.
Each third-party processor is engaged under a written contract requiring them to handle your data only on our instructions and to apply appropriate security measures.
6International data transfers
MÄRKE is based in Hong Kong, and several of the processors listed above are based in or operate from other jurisdictions, including the United States, the European Union, and Canada. Your personal data may therefore be transferred to and processed in countries whose data protection laws differ from those of your country of residence.
Where required by law, we put appropriate safeguards in place for such transfers, including the use of European Commission Standard Contractual Clauses, the UK International Data Transfer Addendum, or equivalent transfer mechanisms recognised under applicable law.
7How long we keep your data
We keep your personal data only for as long as is necessary for the purpose for which it was collected, or for as long as we are legally required to keep it. The principal retention periods are:
- Order and transaction records — seven (7) years from the end of the financial year in which the order was placed, in line with Hong Kong tax record-keeping requirements.
- Account data — for as long as your account is active, plus a reasonable period thereafter; you may close your account at any time.
- Marketing data — until you unsubscribe, after which we retain a record of unsubscription only, to ensure we do not contact you again.
- Analytics and cookie data — for the duration set out in our cookie settings, typically no longer than fourteen (14) months.
8Your rights
Subject to the data protection law that applies to you, you have the following rights in relation to your personal data:
- The right to access the personal data we hold about you.
- The right to request correction of inaccurate or incomplete data.
- The right to request deletion of your data, where we no longer have a lawful basis to retain it.
- The right to object to processing based on legitimate interests, and the right to withdraw any consent you have given.
- The right to request that your data be transferred to you or to another provider in a structured, commonly used format.
- The right to lodge a complaint with a data protection authority — in Hong Kong, the Office of the Privacy Commissioner for Personal Data (PCPD); in the European Union, the supervisory authority of your habitual residence; in other jurisdictions, the equivalent regulator.
To exercise any of these rights, contact us at contact@markestudio.com. We will respond within thirty (30) days, or such shorter period as applicable law requires. We may ask you to verify your identity before acting on a request, to ensure your data is not disclosed to a third party.
9Cookies
The Site uses cookies and similar technologies. Strictly necessary cookies are required for the Site to function — including for the shopping cart, the checkout, and login sessions — and cannot be disabled. Optional cookies, including analytics and advertising cookies, are set only with your consent, given through the cookie banner displayed when you first visit the Site.
You can change your cookie preferences at any time through the cookie settings link in the footer of the Site, or by clearing cookies in your browser. Disabling strictly necessary cookies will impair core Site functionality.
10Children's data
The Site is not directed at, and the products are not marketed to, individuals under the age of eighteen. We do not knowingly collect personal data from anyone under that age. If you believe we have inadvertently collected such data, please contact us and we will delete it promptly.
11Security
We apply technical and organisational security measures appropriate to the nature of the data we hold. These include encryption of data in transit, restricted access to systems holding personal data, and regular review of our security practices and those of our processors. No system is wholly immune from compromise, however, and we cannot guarantee absolute security.
12Changes to this policy
We may update this Privacy Policy from time to time. The current version, with its effective date, will always be available on the Site. Where changes are material — for example, where we begin processing data for a new purpose — we will give you reasonable advance notice by email or through a notice on the Site before the changes take effect.
13Contact
Questions, requests, or complaints about this Privacy Policy or about our handling of your personal data should be directed to contact@markestudio.com.
