Terms of Service

These terms govern your use of marke-global.com and your purchase of MÄRKE products. By using this site or placing an order, you agree to them. Read them carefully.

1About these Terms

These Terms of Service (the "Terms") form a binding agreement between you and VERITAS ("MÄRKE", "we", "us", or "our"), a company registered in the Hong Kong Special Administrative Region of the People's Republic of China, with its registered office at Flat B, 11/F Cheung Fai Building, 45-47 Cochrane Street, Central. The Terms apply to your use of marke-global.com (the "Site"), to any account you create with us, and to any order you place for MÄRKE products.

By accessing the Site or placing an order, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Site or purchase from us.

2Eligibility

To purchase from MÄRKE you must be at least 18 years old and legally capable of entering into a binding contract under the laws of your country of residence. By placing an order you confirm that both conditions are met. We reserve the right to refuse or cancel any order where we have reason to believe these conditions are not satisfied.

3Products and information

MÄRKE produces premium velcro patch carriers and related accessories. Product descriptions, materials, dimensions, and weights published on the Site are provided in good faith and to the best of our knowledge. Because each piece is finished by hand, slight variation in finish, hardware tone, and colour is inherent to the product and is not a defect.

Photographs are intended to represent the product accurately. Screen rendering, lighting, and individual device colour calibration may cause perceived colour to differ slightly from the physical item. Such variation does not constitute grounds for return outside the standard return policy.

4Orders and contract formation

An order placed through the Site is an offer by you to purchase the products selected. Receipt of an order confirmation email is acknowledgement of that offer; it does not, by itself, form a binding contract. A contract of sale is formed only when we dispatch your order and send a shipping confirmation.

We reserve the right to refuse, cancel, or limit any order at our sole discretion, including for reasons of suspected fraud, manifest pricing error, stock unavailability, restrictions on shipping destination, or breach of these Terms. Where an order is cancelled by us, any payment received will be refunded in full to the original method of payment without further obligation.

5Pricing, currency, and payment

All prices on the Site are displayed in United States Dollars (USD) by default. Where the Site offers display in alternative currencies, the rate used is indicative only; the binding price is the USD price at checkout, and the amount actually charged in your local currency is determined by your card issuer or payment provider at the time of authorisation.

Prices include all duties, taxes, and shipping costs payable on standard international orders, except where otherwise stated at checkout. We accept the payment methods displayed at checkout. Payment is taken at the point of order; no MÄRKE product ships before payment has cleared in full.

We reserve the right to correct any pricing error displayed on the Site. Where a manifest pricing error is identified after an order is placed but before dispatch, we will contact you with the correct price; you may then confirm the order at the corrected price or cancel it for a full refund.

6Shipping and final sale

Shipping arrangements, delivery times, and the absorption of international duties are set out in the Shipping & Delivery policy. All MÄRKE products are sold final sale; the limited circumstances in which we will replace or refund — for items that arrive faulty, damaged, or are not what was ordered — are set out in the Final Sale policy. Both documents are incorporated into these Terms by reference and apply to every order.

7Intellectual property

All content on the Site — including the MÄRKE name, the dot-pair mark, all logos, wordmarks, product names, photographs, illustrations, copy, layouts, and code — is owned by MÄRKE or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.

You may view, save, and print pages from the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, transmit, or create derivative works from any content on the Site without our prior written consent. Use of any MÄRKE mark for commercial purposes, including resale listings, is not permitted.

8Acceptable use

You agree not to use the Site in any way that is unlawful, fraudulent, or harmful. You agree not to attempt to gain unauthorised access to any part of the Site, to interfere with its operation, or to introduce any virus, malicious code, or automated scraping tool. You agree not to place orders using false identity, third-party payment credentials without authorisation, or for the purpose of resale outside terms we have separately agreed in writing.

9Disclaimers and limitation of liability

The Site and all products are provided to the extent permitted by applicable law on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that defects will be corrected. Your statutory rights as a consumer are not affected by anything in these Terms.

To the fullest extent permitted by law, our total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising out of or in connection with the purchase of any product or use of the Site, is limited to the price paid for the product giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, loss of opportunity, or loss of goodwill.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

10Indemnity

You agree to indemnify and hold MÄRKE, its directors, officers, employees, and agents harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party right.

11Force majeure

We are not liable for any failure or delay in performing our obligations to you where the failure or delay is caused by circumstances outside our reasonable control, including acts of God, natural disaster, epidemic or pandemic, war, civil unrest, government action, customs delay, carrier failure, fire, flood, strike, or interruption of telecommunications or utility services.

12Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You and we agree that the courts of Hong Kong have exclusive jurisdiction to settle any such dispute or claim.

Where you are a consumer resident in a jurisdiction whose mandatory consumer protection law affords you protections that cannot be derogated from by agreement, those protections continue to apply to you and prevail over any conflicting term in these Terms to the extent so required.

13Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it valid and enforceable, or, if not possible, severed from the remainder of these Terms. The remaining provisions will continue in full force and effect.

14Changes to these Terms

We may update these Terms from time to time. The current version will always be available on the Site, dated by reference to its effective date. Continued use of the Site or placement of new orders after a revision becomes effective constitutes acceptance of the revised Terms. Orders already placed before a revision are governed by the version in force at the time of the order.
